On Tuesday, December 30, 2008, offers from the Martinsburg Police Department conducted a prostitution investigation utilizing a confidential informant. During the course of the investigation, the C.I. met with female, later identified as Paulette Keene, and began conversation regarding prices for sexual acts. A short time later, an agreement was established between Ms. Keene and the C.I. in which she would receive currency in exchange for performing a sexual act. A short time later, Ms. Keene was taken into custody at War Memorial Park.

Drug Arrest
On Tuesday, December 30, 2008, the Martinsburg Police Department conducted a controlled purchase of narcotics utilizing a confidential informant. During the course of the controlled purchase, the C.I. met with a subject, later identified as Timothy Butts, and received Oxycodone medication, a scheduled II controlled substance. Mr. Butts was taken into custody in the area of Winchester Avenue and Wilson Street without incident.

Parking Meter Thefts
The Martinsburg Police Department is seeking the community’s assistance in solving a rash of vandalism and Grand Larceny thefts that has occurred to the Municipal Parking Meters within the city limits.
It appears that through the evening and early morning hours from December 16th through December 22nd 2008 there were approximately thirteen (13) parking meters which were damaged and their coin boxes and content taken. In some instances the entire meter and resting pole were also stolen.
These areas include the 200 block of East King Street, the area of Water and East King Street, the Gaston Caperton Train Station parking lot, and the parking lot area of the Martinsburg Public Library.
Martinsburg Police are making increased area patrols in these locations and are also reviewing video surveillance of these areas.
Anyone with information regarding these thefts and or the identity of said suspect (s) is urged to call the Martinsburg Police Department at 304 264 2100 and or Berkeley County Crime Solvers at 304 267 4999 a monetary reward will be paid for information leading to the recovery of the stolen parking meters and or the arrest of said suspect (s)

Attempted Armed Robbery
On Wednesday, December 17, 2008 at approximately 10:45 p.m. the Martinsburg Police Department responded to Domino’s Pizza located at 1002 Winchester Avenue following an Attempted Armed Robbery. Employees at the business informed responding officers that a black male wearing a black coat, blue jeans and white shoes entered the business, brandished a knife and demanded money. The suspect leaned over the counter, grabbed one of the employees and held the knife to his throat resulting in a minor injury to the employee. After the suspect was unable to obtain money he left the business. A medic unit from the Martinsburg Fire Department was summoned to the scene but the victim declined medical treatment. Officers and a K-9 unit searched the area but were unable to locate the suspect.
Additional descriptors of the suspect are 6’02”, 180 lbs. and short black hair. The suspect was captured on the business surveillance video wearing a Baltimore Orioles ball cap and a Bud Light towel concealing his face. Drug Arrests
On Saturday December 13th 2008 at 5:50 PM Martinsburg Police arrested two individuals on drug charges while in the 500 block of West Race Street Martinsburg WV.
It is alleged in the complaints for warrants that Ptlm. Derek English observed and encountered two individuals frequenting a residence located on English Street in which several complaints had been generated for possible drug activity.
During his encounter and investigation a quantity of illegal controlled substances were located upon their person and a sum of money.
Both individuals were arrested and brought to the police department. Once at the police department a more concise inventory of the controlled substances was determined.
One of the individuals had in his possession a plastic bag that contained approximately 10 individually packaged bags of suspected powder cocaine, 10 individually wrapped suspected ecstasy pills and 150 individually packaged bags of suspected crack cocaine.
The other suspect had several bundles of cash upon his person that were in denominations and stacks consistent with that of drug trafficking.
Suspect #1 Christopher Michael Roof DOB 9 6 77 of 510 Lake Michelle Ct. Stone Mountain Georgia, was charged with possession with intent to deliver powder cocaine, crack cocaine and ecstasy pills and conspiracy to deliver controlled substances.

Breaking and Entering
On Friday, December 12, 2008, Ptlm. M. Jones responded to the Church of the Bible Covenant, located at 706 Sheridan Avenue, Martinsburg, in reference to a Breaking and Entering that had occurred. Upon investigation, it was learned that the building had sustained property damage and that audio equipment was stolen. Search Warrant - Arrests
On Monday, December 8, 2008, the Eastern Panhandle Drug and Violent Crime Task Force, along with the Martinsburg Police Department Special Response Team, executed a search warrant at 110 South Kentucky Avenue, Martinsburg WV, in regards to an ongoing drug investigation. The Special Response Team was utilized to make forced entry into the residence, which resulted in 3 subjects fleeing the residence out of a back door.
Task Force officers were stationed to the rear of the residence and encounter two male subjects fleeing while brandishing each a .357 handgun. Both subjects were taken into custody and identified as Lateef McGann and Jesse Jarvis. Upon searching Mr. McGann, a quantity of crack cocaine was located on his person, which resulted in him being charged with Possession with intent to distribute crack cocaine. Mr. Jarvis was determined to be a convicted felon and was charged with being a convicted felon in possession of a firearm. A female identified as Shaina Jarvis also fled out of the back of the residence and was charged with Obstruction.
Also charged with Obstruction in the incident was Bernadino Perez, who refused to comply with police commands upon entry into the residence.
A search of the residence yielded a sawed off shotgun, 2 other shotguns and a third handgun. In total, 6 firearms were seized from the residence and its occupants.
All subjects arrested were taken to the Eastern Regional Jail to await arraignment.

Destruction of Property
On Saturday, November 29, 2008 at 1412 hours, the Martinsburg Police Dept responded to 610 South Raleigh Street for a report of several juveniles around the house holding bricks. Upon arriving at the scene, Officers saw two rear windows of the residence broken out and a brick on the inside. While at the residence, Martinsburg Police received a separate call of juveniles in the area of Boydville with golf clubs. Cpl. Funkhouser and Ptlm. Somers responded to Boydville from Raleigh Street and located 5 juveniles in the back of an old ambulance with golf clubs.
After speaking with the juveniles, it was discovered that they were responsible for breaking out the window at 610 South Raleigh Street and they had also broken out some windows to a greenhouse at Boydville. Further investigation revealed that some of the juveniles were also responsible for damages caused to a vehicle to the rear of 639 South Raleigh Street which was reported on Friday as well as damages caused to a vehicle at Martinsburg Concrete on Saturday.

Shots Fired
On Sunday, December 07, 2008, at 0015 hours, the Martinsburg Police Dept responded to 103 Ramer Court for a report of shots fired. Four subjects were standing outside 103 Ramer Court when two subjects walked past the residence and began a verbal confrontation. Both sides exchanged words and then one of the subjects that was walking past the residence pulled a gun and fired several rounds at the four victims. None of the victims were shot, but some of the bullets struck a neighbors house at 105 Ramer Court. There were several people inside the residence, but no one was injured.

Drug Arrest
On Thursday, December 4, 2008, Det. Lt. G.B. Swartwood, Det.S.F. Doyle, Ptlm. D. English and Ptlm. J. Luciano conducted a controlled purchase of narcotics utilizing a confidential informant. During the course of the investigation, a C.I. met with an unknown female and conducted a transaction in the 100 block of Pennsylvania Avenue, in which the female provided crack cocaine to the informant in exchange for currency. A short time later, the female was taken into custody and identified as Elizabeth Sarah Miller. Ms. Miller was charged with Delivery of a Controlled Substance and was taken to the Eastern Regional Jail to await arraignment.

Scam / Theft
On Wednesday, December 3, 2008 at 3:15 p.m. the Martinsburg Police Department responded to the 200 block of North Georgia Avenue regarding a complaint of a larceny.
The investigation revealed that a white male approached the back door to a residence and asked the female homeowner if she needed her driveway paved. After the homeowner told the individual no he then asked to use the bathroom. The homeowner allowed this individual in to use the bathroom. As the homeowner was escorting the male to the bathroom another white male entered her residence through the same back door. He asked to use the bathroom also. The homeowner refused the second request and escorted the individual back outside. After the first male finished using the bathroom the individuals left. The homeowner subsequently noticed that her wallet she had on the table was missing.
The investigation revealed the suspects are three (3) white males in their late thirties and were driving a late nineties model Chevrolet pickup truck. Credit cards and an undisclosed amount of cash were stolen in this incident. The Martinsburg Police Department wants to remind citizens to be suspicious of any unexpected visits from individuals wanting to do work and to refrain from allowing individuals with whom they are not familiar to enter their residence.

Poss w/ the intent to del cocaine / heroin
On Monday, November 24, 2008, the Eastern Panhandle Drug and Violent Crime Task Force executed a search warrant at a Martinsburg area motel with the assistance of members from the ATF, Martinsburg Police Department and West Virginia State Police.
Upon entry into the room, officers located a sole occupant, Jomo Kenyatta Morris. A search was then conducted in the room that yielded a quantity of crack cocaine and heroin. Mr. Morris was then arrested by the Martinsburg Police Department and was charged with Possession with intent to deliver crack cocaine and Possession with intent to deliver heroin.
Mr. Morris was arraigned at the Berkeley County Judicial Center by Magistrate Humphrey was then given a $100,000 cash only bond. Mr. Morris was then remanded to the custody of the Eastern Regional Jail.

Conspiracy / Poss with Int to Del Marijuana
On Friday, November 14, 2008 at approximately 6:45 pm, Ptlm. English of the Martinsburg Police Department initiated a traffic stop on a vehicle in the 300 block of North Queen. Upon approach of the vehicle, Ptlm. English identified the driver as Richard M. Smith and also detected an odor of marijuana in the vehicle. Mr. Smith was removed from the vehicle and a bag of marijuana was located on his person. He was then placed under arrest and put into the back of the cruiser. A short time later, Ptlm. Albaugh of the Martinsburg Police Department, located a second bag of marijuana in the back seat of the cruiser where Mr. Smith was secured. At that point, Mr. Smith was charged with Conspiracy to Deliver Marijuana and Possession with intent to Deliver Marijuana.
The passenger in the vehicle, identified as Navarre Sowell, was also arrested and charged with Conspiracy to Deliver Marijuana and Possession with Intent to Deliver Marijuana
The total amount of marijuana seized was over 26 grams and over $2,400 in currency was confiscated. Both men were arrested and taken to the Eastern Regional Jail to await arraignment.

During the course of conversation, the female solicited sexual favors in exchange for money. A short time later, the female was taken into custody and identified as Breshannon Devereaux. Fugitive / Poss w intent arrests
On November 17th 2008 Tuesday at 6:05 PM Martinsburg Police executed a search warrant and a fugitive arrest warrant at 400 Bertelli Court, Martinsburg, WV utilizing the Martinsburg Police Department Special Response Team.
The search warrant and fugitive arrest warrant were part of a joint investigation which was conducted with members of the United States Marshal Service, New York City Police Department Homicide Squad , Martinsburg Police Detectives, Montgomery County, Maryland Police Department and members of the West Virginia State Police.
The investigation culminated in the search warrants and arrest warrant after Martinsburg Police detectives were contacted by Deputy United States Marshal Michael Ulrich in regards to a fugitive wanted for homicide that was possibly residing at 400 Bertelli Court Martinsburg WV. Information was gained through the investigation which confirmed the belief that the suspect was indeed at the residence.
The Special Response Team was utilized to make a forced entry to the residence and secure potential suspects inside of the residence. Entry was made by compromising the front door of the residence and two occupants were secured inside.
The fugitive was arrested by Martinsburg Police on a fugitive from justice warrant which was obtained from State Magistrate Joan Bragg. Once inside of the residence police located evidence which indicated that the residence may contain controlled substances and proceeds from the sales of controlled substances. The residence was secured and a second search warrant was obtained and executed for controlled substances and the proceeds from sales of controlled substances. The second occupant of the residence was later arrested for possession with intent to deliver controlled substances (Crack Cocaine).
The fugitive was identified as Geovanny Colon in which a warrant for murder had been secured in New York City in 2007. It was also determined that this subject had previously been listed as a fugitive from the television program “Americas Most Wanted”.
Items seized in the search of the residence were approximately seven grams of Crack Cocaine, $24,184 dollars in currency, fifteen (15) cell phones, some jewelry items and a 42 inch High Definition flat screen television.

Felony Animal Cruelty
The Martinsburg Police Dept responded to 252 E. Burke St on Nov 12 at 8:00 pm and assisted Berkeley County Animal Control with an animal cruelty complaint.
A 3 year old Pit Bull was found within the residence and was a victim of malnutrition, neglect and abuse which consisted of taping the dogs mouth closed with duct tape and it was chained in the attic of the house. The dog had open wounds on its nose and mouth. The dog was very underweight and was visibly shaken. Witnesses said the abuse had been going on for several weeks and that the dog had also been beaten.

The dog was turned over to Animal Control and it was taken for treatment for its injuries. The suspects were arrested on Nov 13. Devereaux was arrested at 252 E. Burke St and Siford was later picked up after he was found hiding in the house. Both are charged with Felony Animal Cruelty. The cruelty of the animal was described as one of the top 5 cases of animal cruelty within the City.

On Wednesday, November 12, 2008, Det. Lt. G.B. Swartwood arrested Alfonso Sanchez on Felony Child Neglect and Felony Child Abuse, stemming from an incident occurring on or around 10/19/08. In the complaint it is alleged that the defendant knocked over a chair that had contained his 5 month old daughter, causing the infant to be struck in the head. Two days after the incident, doctor’s viewed the child on an unrelated visit and determined that the infant had a fractured skull. Subsequently, the child was transported to the Children’s Hospital where she remained for several days until her release. The child currently is in the care of a Department of Health and Human Resources (DHHR) representative. The defendant was arraigned before Magistrate Overington and was given a $35, 000 bond.

During the course of the purchase, the Confidential Informant met with an unidentified male and traveled to the 100 block of South Tuskegee Avenue. The unidentified met with a second unidentified male, who was residing at the Rescue Mission, located at 602 West King Street, and received marijuana. The male then returned to the Informant and delivered the purchased marijuana. Subsequently, the male was taken into custody for Delivery of a Controlled Substance (Marijuana) and identified as Philip Miller, also resident of the Rescue Mission.
A short time, Det. Lt. G.B. Swartwood and Ptlm. Luciano responded to the Rescue Mission and identified the person who had sold the marijuana as Adam Ryan. Arrest / Child Neglect
On 11 03 08 at 2:40 PM Martinsburg Detectives arrested a suspect on two outstanding felony warrants for child neglect.
These warrants were issued previously by State Magistrate Sandra Miller for two counts of felony child neglect. It is alleged in the warrants that these cases stem from the incident which occurred on October 28th 2008 at approximately 3:06 AM when Martinsburg Police responded to the 300 Block of South Water Street in reference to an abandoned child. Officers arrived at the scene and located a small infant approximately two to three years of age and also a child safety seat which had been left along the sidewalk.
It was also alleged in the warrant that the defendant had an additional four year old daughter at her residence when speaking to the police on 10 29 08. And that the mother and her daughter were brought to the police department were an interview was attempted.
Both infants have been released to a DHHR representative who currently has custody of both children.
The defendant was processed at the Martinsburg Police Department and later arraigned by Magistrate Overington. Her bond was set at $50,000 and she is currently incarcerated in the Eastern Regional Jail in lieu of said bond.

Attempted Purse Snatching / Arrest
On Wednesday, October 29, 2008, at 11:55am, the Martinsburg Police Department was called in reference to an attempted purse snatching that occurred at Wendy’s, located on North Queen Street in Martinsburg. Upon speaking with the female victim, it was advised that a black male had ran at her in the parking lot but that she clenched her purse tightly so that it was not taken. Witnesses advised officers that that the subject was accompanied by a white male and that they were driving a white Lincoln with a dark top.
Officers searched the surrounding area located a white Lincoln sedan with a dark top in the 400 block of Center Street, which had two black male subjects and one white male subject in close proximity. The subjects were ordered to stop and the white male fled on foot.
The white male was eventually taken into custody after a brief struggle on Avery Street. The male was identified as a 16 year old Juvenile from Hagerstown Maryland. He was charged with a variety of offenses and was detained in the Juvenile Detention Center.

On Tuesday, October 28, 2008 at 1:02 am the Police Department received a call at 255 N. Queen Street in the area of the Variety Bookstore for an armed robbery. The victim was in the alley to the rear of the bookstore as he was approached by a lone B/M wearing a white and black hooded jacket. He said he had a handgun and demanded money from the victim. The suspect took the wallet from this victim after a struggle. The victim was knocked to the ground. The suspect was last seen running toward Spring Street. The suspect is described as approximately 6-2 having a mustache.
The victim of this robbery was Raymond Rock. His address will not be released. Mr. Rock is 55 years of age. He received various minor abrasions and refused medical treatment. The victim stated he had approximately 300 dollars in cash with him.

Abandoned Child
On October 28th 2008 at approximately 3:06 AM Martinsburg Police responded to the 300 Block of South Water Street in reference to an abandoned child. Officers arrived at the scene and located a small infant approximately two to three years of age and also a child safety seat which had been left along the sidewalk.
A witness advised that they observed a vehicle in the area shortly before observing the child. It was advised the child was not in the car seat but was running towards the departing vehicle.
Martinsburg Police Detectives were able to identify the abandoned child after her photograph was released to the media. A witness came forward to the police and advised she recognized the photo of the child as a child that she had previously watched in the past.
At approximately 11:59 AM Martinsburg Police were able to locate a residence for the abandoned two year old infant and Det Lt. GB Swartwood and Ptlm. D. English responded to this Martinsburg West King Street area residence.
The mother of the infant child was located at the residence and she identified the photograph of her child. She was advised her child had been taken into the custody of the Martinsburg Police Department. She also had an additional four year old daughter at her residence. The mother and her daughter were brought to the police department were an interview was attempted.
The mother was later taken by emergency medical personnel to Martinsburg City Hospital after she complained of an illness. Her four year old infant daughter was taken into the custody and care of the Martinsburg Police Department and later released into the custody of a DHHR representative. DHHR currently has custody of both children.

Poss with the Intent to Deliver
On October 24th 2008 at 6:00 PM Martinsburg Police arrested an individual on the charges of possession with intent to deliver a controlled substance for (Heroin) and (Crack cocaine). This arrest took place in the area of West Burke Street and Tuskegee Ave, Martinsburg WV.
It is alleged in the complaint for warrants that Ptlm. D. English of the Martinsburg Police Department performed a traffic stop for a windshield obstruction and for failure to stop at a stop sign. After an initial contact with the driver, Ptlm. English asked and was given consent to search the driver and his vehicle. It is alleged that a small amount of Marijuana was located in the vehicle and the driver was then arrested and transported to the police department.
Once at the police department sixteen (16) packages of suspected Heroin were located on the defendant along with five (5) individual packages of suspected crack cocaine. The heroin had a weight of approximately 5.9 grams and the crack cocaine had a weight of approximately 1.9 grams.
The defendant was then charged with the two felonies of possession with intent to deliver Heroin and Crack cocaine. The defendant was processed at the Martinsburg Police Department and later incarcerated in the Eastern Regional Jail awaiting arraignment by a State Magistrate.

Breaking and Entering
On Thursday October 23, 2008 at 1:58 am the Police Department received a call at the Quick Check Convenience Store at 301 Rock Cliff Drive for a burglar alarm. Officers found the front door to this store had been broken. Officers awaited the arrival of the store owners and accessed the in store surveillance system which showed the person that broke in.
The man used the front of his white Honda sedan to break open the front doors. Once the doors had shattered he went in and was seen in and around the counter area of the store, and it appeared that nothing was removed as the audible alarm caused him to leave quickly
Other officers received the description of the vehicle and method used in the crime and began a search for the vehicle. Cpl. Craig Phelps located the suspect vehicle in the parking lot of Martin’s on S. Foxcroft Ave. The vehicle was unoccupied at 2:50 AM. Officers checked the area and located the same suspect from the Breaking and Entry inside of Martin’s. The suspect was wearing the same clothing from the Quick Check and was taken into custody. The exterior of the vehicle showed evidence of the crime (broken glass and paint exchange) from the front of the store.
Arrested was John Andrew Jollon age 44 of 214 Polo Green Drive Apartment 53 Martinsburg WV. Jollon was taken into custody without incident, processed and will be arraigned by a magistrate for the charge of Breaking and Entry. Jollon is currently incarcerated in the Eastern Regional Jail awaiting that arraignment. The investigation continues.

Guilty Plea
On Thursday, October 16, 2008, Mr. Roger Fazio of 116 East King Street, Martinsburg WV (King’s Daughter Court), pled guilty to one count of Battery and was issued a $50.47 fine in Berkeley County Magistrate Court. The plea was accepted by Magistrate Overington.
Mr. Fazio was initially charged and arrested on Battery from an incident that occurred on August 25, 2008 at the King’s Daughter Court apartment complex, located at 116 East King Street, Martinsburg WV. During the incident, Roger Fazio had a verbal altercation with a 78 year old female tenant as she attempted to enter the building. Upon entering the building, Roger Fazio shoved the door shut on the female’s arm, which caused it to be lodged in the doorway. As a result of the incident, the victim sought medical treatment and was observed with bruising to her arm.

On Tuesday, October 7, 2008 at 4:47pm, the Martinsburg City Police Department conducted a controlled purchase for narcotics using a confidential informant in the 200 block of South Maple Avenue, Martinsburg WV. During the investigation, a transaction occurred in which the confidential informant provided money to an unknown person in exchange for marijuana. Following the transaction, the person was arrested and found to be in possession of other marijuana and money used in the transaction with the informant. The person was identified as Ronald Cox.

Stabbing / Arrest
On Wednesday October 8, 2008 at 1:30 AM the Martinsburg Police Department received a call concerning a fight in the 200 block of S. Kentucky Ave. As officers were in route we received information that a person had been stabbed.
Officers arrived and located several persons in the 200 block of S. Kentucky Ave. and the victim of the stabbing. The victim had received several lacerations in the head, rear of the neck and his back with what appeared to be a razor knife. The victim is Thomas T. Nicholson III 402 W. King Street Martinsburg age 21. These wounds are not life threatening and Nicholson’s was treated and released from City Hospital.
The male assailant in this case is 16 years old. This stabbing was a result of an on going disagreement between these two people. The assailant was treated at City Hospital for wounds that occurred in the altercation with Nicholson. The assailant was processed, arraigned and was detained by the court in the Juvenile detention Center. The juvenile was charged with Malicious Wounding.

On Thursday, October 02, 2008, Richard Moore, a teacher at North Middle School was arrested on a battery charge. The Martinsburg Police Department was notified of the incident, which was investigated by Ptlm. Neely. It is alleged in the warrant that Mr. Moore did commit a battery against a 14 year old juvenile male at North Middle School.

Heroin Arrest
On Thursday, September 25, 2008, the Martinsburg Police Department conducted a controlled purchase of narcotics utilizing a confidential informant. During the incident, the informant met with an unidentified female, who arranged to purchase heroin from another individual. The female then left the C.I., met with another subject and then returned back to the C.I. At that point, a transaction occurred in which the C.I. received the purchased heroin. Following the transaction, officers arrested the female and identified her as being Mistie Keeney.
Mistie Keeney was charged Delivery of Heroin and was taken to the Eastern Regional Jail to await arraignment.

Armed Robbery / Arrest
On Monday September 29, 2008 at 4:55am, the Martinsburg Police Department responded to the area of Second and Queen Streets in reference to an armed robbery that had occurred. Ptlm. Bleigh made contact with the victim, who advised that she was walking to work when she was approached by two black males wearing dark clothing. It was advised that one male produced a handgun, pointed it at her and took currency from her purse. Both subjects then fled the area and the victim contacted 911.
A short time later following the incident Ptlm. Bleigh was able to develop a suspect in the incident, which was positively identified by the victim and witnesses. The suspect who produced the handgun was identified as Lamar Taylor.
Ptlm. Bleigh then applied for and obtained an arrest warrant for Robbery for Lamar Taylor, which was issued by Magistrate Miller. It was then learned that Lamar Taylor was staying at a residence at 36 Mabel Lane, Martinsburg WV. A short time later following the incident Ptlm. Bleigh was able to develop a suspect in the incident, which was positively identified by the victim and witnesses. The suspect who produced the handgun was identified as Lamar Taylor.
Ptlm. Bleigh then applied for and obtained an arrest warrant for Robbery for Lamar Taylor, which was issued by Magistrate Miller. Following the arrest of Lamar Taylor, the second suspect in this incident was identified as Davaun Ambush. Both suspects were also found at the same address during the arrest of Lamar Taylor.

Purse Snatching / Arrest
On Thursday, September 25, 2008 the Martinsburg Police Department received a complaint of a purse snatching at the Martinsburg Mall located at 800 Foxcroft Avenue. Officers responded to the scene and relayed information for a be-on-the-lookout for a green Ford Mustang being operated by a black male. The 57 year-old female victim from Winchester reported she had just arrived at the mall and parked in front of Bon Ton. As she was walking to the entrance she heard someone running and the individual yelled “Hey, hey!” The victim turned around thinking it was someone she knew and the suspect forcefully grabbed the purse from her arm. The suspect fled the scene in the Mustang and the police were called. The Berkeley County Sheriff Department located a suspect and vehicle matching the description given. The investigation resulted in the purse belonging to the victim being located within the vehicle found by the sheriffs department on Kaufman Avenue. The driver and sole occupant of the Mustang, Matthew Lonelle Brown, 25 years of age, of 616 North Queen Street, Martinsburg stated he had found the purse on Mall Drive. Brown was subsequently arrested and charged with the felony charge of Aggravated Robbery. Brown was incarcerated in the Eastern Regional Jail to await arraignment by a Berkeley County Magistrate.
Drug / Fugitive Arrest
On Tuesday, September 23, 2008 at 11:32pm, Ptlm. English of the Martinsburg Police Department was on patrol in the area of Tavern Road and Tennessee Avenue, when he observed a vehicle fail to stop at a stop sign. Ptlm. English then initiated a traffic stop on the vehicle in the parking lot of the Martins Landing Apartment Complex.
Upon making contact with the driver, identified as David Deon Brown (DOB: 03/13/76) it was learned that he had a suspended driver’s license. Ptlm. Rouse of the Martinsburg Police Department then made contact with the passenger, who identified himself as Jaquin Moore. The passenger was subsequently removed from the vehicle and a bag containing ecstasy pills was located near his person on the ground. At that point, both persons were arrested and transported back to the Martinsburg Police Department.
Once back at the Martinsburg Police Department, Ptlm. Rouse conducted another search of the passenger and located two bags containing approximately 10 grams of cocaine. The passenger also advised officers that he had falsely provided the name of Jaquin Moore and that his name was Derrick Demond Brown. It was later determined that Derrick Demond Brown was wanted in Florida for a probation violation for 2nd Degree Murder, Robbery and two counts of use of a Deadly Weapon. He was then charged with 2 counts of Possession with Intent to Deliver a controlled substance (ecstasy, cocaine) as well as being a Fugitive from Justice.

Burglary Arrests
On Wednesday, September 24, 2008 at approximately 0052 hours, the Martinsburg Police Department responded to 2500 Martins Landing Circle Apt.#525 for a report of a burglary in progress. The resident, Justin Parsons, called 911 stating that three male subjects were kicking in his door. Mr. Parsons attempted to brace the door by placing his feet against the door and his back against an interior wall. The suspects kicked the door with such force that Mr. Parson was pushed through the drywall that his back was braced against. Once the subjects gained entry, they realized that someone was within the residence and fled. Officer Q.D. Burner arrived on scene and observed two subjects in front of the apartment building at which time he detained them.
The subjects matched the description given by the victim and were later positively identified by the victim as the subjects that broke into his apartment.

Martinsburg police are seeking information in regards to two (2) robbery incidents which occurred on Monday September 22nd 2008. The first street robbery occurred to a fifty-three year old male Virginia resident who was struck from behind while in the 100 block of East Race Street at approximately 2:20 AM.
The victim advised he was struck in the head from behind after leaving the Variety Book Store. The victim advised after being jumped he woke up in the middle of the street and then went to the police department to report the robbery. He advised that his wallet and contents were taken. He was then transported by Martinsburg Fire Department emergency personnel to Martinsburg City Hospital for treatment.
The second incident occurred at approximately 6:27 AM in the 200 block of East Martin Street Martinsburg WV. In this incident a fifty-three year old male Martinsburg resident had suffered a head injury after being accosted on the sidewalk in the 200 block of East Martin Street. A witness advised that he heard a subject screaming for help and encountered a subject leaving the area. This subject is described as a black male approximately 6-0 to 6-3 in height and weighing 200 pounds and wearing dark clothing. This subject then fled the area on East Martin Street heading towards Queen Street. The witness then rendered aid to the victim.
The victim advised that he was walking east on Martin Street towards the train station when he was struck in the head from behind. He advised the suspect was a black male and that he demanded his wallet and then knocked him to the ground. He was then struck numerous times by the suspect.

Heroin Arrest
Martinsburg police officer Ptlm. D. English arrested an individual for possession with intent to deliver a controlled substance (Heroin) in the 200 Block of Winchester Ave. on Wednesday September 17th 2008. It is alleged that Ptlm. English spoke to this person after observing him yelling at a female.
It is alleged that during his investigation several small pieces of straw which were separated into two bundles, were discovered in a cigarette pack in the subject’s possession which contained Heroin. Drug Arrests
Martinsburg Police officers and Detectives arrested three individuals for Delivery of a Controlled substance (Crack cocaine) in the area of the 100 block of East Burke Street and in a vehicle stop in the area of the 200 Block of South College Street at approximately at 5:15 PM.
It is alleged that an individual sold crack cocaine to a confidential police informant in the 100 block of East Burke Street and was apprehended by police without incident. It is also alleged that the subjects that brought the crack cocaine left the area in a silver Mercury sedan and were apprehended in the 200 block of South College Street without incident.
All three subjects were arrested for delivery of a controlled substance and brought to the Martinsburg Police Department for processing and taken to the Eastern Regional Jail to be arraigned by a State Magistrate later this evening.

Martinsburg Police Officer Ptlm. English arrested an individual for possession with intent to deliver Crack cocaine on Sept. 11 2008 at approximately 7:36 PM. It alleges in the complaint for warrant that Ptlm. English was investigating a complaint of drug activity at 396 West Race Street Martinsburg WV when he asked and received permission to search room #7 at that residence.
He located a zip lock bag which contained four (4) smaller zip bags which contained suspected crack cocaine. The total weight of the suspected Crack cocaine was 1.8 grams and later field tested positive for cocaine.
A subject was arrested and charged with Possession With Intent To Deliver a Controlled Substance (crack cocaine). He was processed at the Martinsburg Police Department and later taken to the Eastern Regional Jail to await arraignment by a State Magistrate.

Burglary Arrests
Martinsburg Police Detectives arrested two juveniles ages eleven (11) and sixteen (16) in regards to two burglaries which occurred on Thursday July 24th 2008. Both of these juveniles are Martinsburg residents. Their cases are now turned over to the Berkeley County Prosecuting Attorney’s Office for further juvenile prosecution.
One of the burglaries occurred at a residence located in the 900 block of West Race Street Martinsburg WV. Entry was made via an outside rear door and several items were taken from the residence. Numerous items including jewelry and electronic equipment were taken and the police department had notified area pawn shops of these thefts with their descriptions.
The other burglary occurred at a residence located in the 300 block of North Louisiana Ave. Martinsburg WV. Entry was made to this residence via a basement window some items were taken from this residence as well. Descriptions of theses items especially the stolen jewelry were also given to area pawn shops.
These juveniles were arrested by Det Lt GB Swartwood and both were charged with (2) counts of Burglary and (1) count of Transferring Stolen Property. Police were able to re-obtain several of the stolen items including lap top computers, I-pods, digital camera, a Sony Play Station and some jewelry which belonged to the victims. Wanton Endangerment
On September 4th, 2008 at 2:30 AM Martinsburg Police responded to a shots fired call in the area of East Moler Ave. and North High Street. Officers initially did not locate any persons or vehicles involved in the shooting.
Later in the morning Martinsburg Detectives located the vehicle which was involved in this shooting parked in the Roberts Gardens apartment complex located outside of the city limits. The vehicle had sustained obvious recent gunshot damage from several projectiles.
The vehicle had sustained multiple areas of gunshot damage and it appeared to have been caused from at least two, possibly three different caliber weapons.
One of the two occupants believed to be in this vehicle at the time of the shooting was located and interviewed. The other occupant was identified by police. Neither of the two occupants were struck by bullets or injured in regards to this incident.
Police were able to find that the occupants of the vehicle had traveled to the area of High and Moler and parked in the alley way beside of 820 North High Street and met with several people in that area. An argument ensued with several of these people and with the passenger of this vehicle and as they were leaving several shots were fired at the vehicle and occupants.
Martinsburg Police were able to identify these subjects and warrants for Wanton Endangerment were obtained by Det Lt. GB Swartwood and Det Cpl. S Doyle from State Magistrate Joan Bragg.
Martinsburg Police have arrested four individuals on said warrants in regards to this incident. The investigation is ongoing and it is possible that another arrest may be forthcoming.

Arson Arrest
On August 23rd, 2008 at approximately 9:06 PM Martinsburg Police and Fire Department responded to a structure fire at 109 Centre Street Martinsburg WV. The residence was occupied by at least two female residents at the time of the fire. No one was injured in this fire.
Upon investigation the fire was ruled an arson by Fire Investigator Gregg Hoover and it appeared that it started on or beneath the front porch of the residence.
Martinsburg Police officers Sgt M. Zollinger, Ptlm D. English and Ptlm E. Neely were able to identify witnesses that advised them of an individual speaking about starting the fire and also other information regarding his involvement. These witnesses were later identified and statements were taken from them.
A warrant charging a suspect with First Degree Arson was obtained by Det. Lt. GB Swartwood from State Magistrate Joan Bragg. It alleges in the complaint for warrant that the defendant told a witness that he started the fire by lighting some type of fuse on the porch of the residence and then fleeing from the fire and going home to his residence to change clothes.
Martinsburg police officers after obtaining this warrant arrested the suspect at his residence at approximately 2:00 AM on August 24th 2008 without incident. The defendant was taken into custody and processed at the Martinsburg Police Department and later transported to the Eastern Regional Jail to await arraignment later in the morning.

Kidnapping / Burglary
On 8/7/08 at 8:30 AM Ptlwm. Barrett and Ptlm. Herb responded to an apartment on W. King St for a violation of a Family Protection Order. The officers interviewed the victim who said that she had been woke up in the middle of the night by her ex-boyfriend, 30 yr old Steven Grieco who was holding a knife to her throat. Evidence at the scene indicates that Grieco gained entry to the apartment by removing a window pane, and then laid in wait until the victim was asleeep. Grieco is alleged to have forced the victim from the apartment at knifepoint and led her to his apartment on Boyd Ave. Despite attempts to leave, Grieco held the victim there for several hours. The victim was later released by the suspect after agreeing to contact him later in the day.
Warrants charging the suspect with Burglary and kidnapping were issued by Berkeley County Magistrate Joan Bragg. At 3:15 PM Ptlwm. Barrett monitored a call placed by the victim to Grieco. Grieco agreed to meet with the victim at the intersection of Boyd Ave and W. Race St, assuring her that he would be unarmed at the time. When the suspect arrived at that location, he was taken into custody without incident by Police. At the time of his arrest he was found to be in possession of a large knife consistent with that described by the victim.
A search warrant executed at the apartment of Greico yielded addditional evidence in the case.

Arrest - Bldg Entered
On Friday, Aug 8 at 3:31 AM the Police Department received a business alarm at the Briarwood Professional Building at 1004 Sushruta Drive Martinsburg. Responding officers found an unsecure door on the front of the office complex. A search of the building resulted in a suspect being located within an office. The suspect entered through the front door and proceeded through the building via an area above the ceiling. The suspect at one point fell through the ceiling before being apprehended by the officers. The suspect admitted he had entered the building for the putpose of obtaining Xanax, a prescription drug.
The suspect Zachary Allan Recht, 25 of Crist Lane Inwood WV was taken to the Eastern Regional Jail to await arraignment by a Berkeley County Magistrate on a felony charge of Entering withoiut Breaking.

Arrest - Trespass / Vehicle Tampering
On Wednesday, August 6, 2008 at 12:48 a.m. the Police Department received a complaint of a suspicious person in the 800 block of Honeysuckle Drive located in the Briarwood Subdivision. The reporting person stated she observed a man walking out of her driveway. The man allegedly proceeded to the neighbors SUV and attempted to enter the vehicle. Officers searched the area but were unable to locate the suspect. At 3:16 a.m. the Martinsburg Police Department received a second call of a suspicious person at a separate location in the 800 block of Honeysuckle Drive. The individual was located by police on the front porch of a residence. The description matched that of the individual in the earlier incident. The suspect was positively identified by the initial complainant as being the same individual. The individual was highly intoxicated. The suspect, David Chiveral, Jr., 39 years of age, was arrested and subsequently incarcerated in the Eastern Regional Jail to await arraignment by a Berkeley County Magistrate on charges of Trespass, Tampering with a Vehicle and Public Intoxication.

Drug Arrest
On Monday, August 04, 2008 at 1104 hours, Ptlm. S.A. Shelton of the stopped a vehicle in the 1300 block of West King Street after he recognized the driver of the vehicle as Donald Watson who did not have a valid license. Upon stopping the vehicle, the driver was identified as Mr. Watson who said that his license was suspended and a female passenger was identified as Roberta Lowe. Officer Shelton received consent to search Ms. Lowe’s property and found a gallon Ziplock baggie full of a green leafy substance in Ms. Lowe’s purse. The substance field tested positive for marijuana and weighed approximately 150 grams.
Roberta Lowe (07-19-1963) of 409 West Race Street #7 Martinsburg, WV was arrested for possession with intent to deliver a controlled substance. She was arraigned by Magistrate Bragg and transported to ERJ on a $10,000 bond. Mr. Watson was issued a citation for driving suspended and released.

Assistance needed on burglaries
The Martinsburg Police Department is seeking the community’s assistance in regards to two burglaries that occurred on Thursday July 24th 2008. Both of these are believed to be related in regards to their time frame and general location.
One of the burglaries occurred at a residence in the 900 block of West Race Street Martinsburg WV. Entry was made via an outside rear door and several items were taken.
The other burglary occurred at a residence in the 300 block of North Louisiana Ave. Martinsburg WV. Entry was made via a basement window some items were taken from this residence as well.

Drug Arrest
On Tuesday, July 22, 2008, Ptlm. English stopped a vehicle in the 600 block of Third Street. During the stop, Ptlm. English searched the vehicle and located Oxycodone, a controlled prescription medication that did not belong to the driver and small amount of marijuana. The drugs were possessed by the driver. The driver, identified as Courtney Fay Whittington, was then arrested and charged with driving without a license and two counts of possession of controlled substances.

Person Wanted
The Martinsburg Police Department is requesting the community’s assistance in locating Samuel Lee Rose Jr., who is wanted for one count of Delivery of a Controlled Substance. The warrant was obtained following a controlled purchase of crack cocaine from the suspect in May 2008 by use of a confidential informant. Armed Robbery and Kidnap Warrants Obtained
On July 17th 2008 Martinsburg Detectives obtained warrants for Armed Robbery and Kidnapping from State Magistrate Sandra Miller. These warrants were issued in regards to an incident which had occurred on November 16th 2007 at a residence in the 600 block of West Virginia Ave. Martinsburg WV.
In the complaint for warrant Det Lt GB Swartwood alleges that this robbery occurred at a residence in the 600 block of West Virginia Ave. It is alleged that the two (2) suspects forced the female resident into her home at gun point and then forced her through her residence to the basement where she was tied up by the suspects.
The suspects then took the victim’s wallet and her vehicle. A white and gray Ford F-150 pick up truck and fled the area. A short time later two subjects matching the description as the robbers involved attempted to enter an area bank but were unsuccessful. The victim’s vehicle was later recovered off of Fairfax Street in Martinsburg WV.
Later in the investigation detectives were in contact with Hagerstown Maryland Police Dept detectives who were working a bank robbery in which a suspect was apprehended, this information was shared with Martinsburg authorities.
It alleges in the warrant that an individual was recently able to identify one of the subject’s from the Martinsburg area bank surveillance film and provided his identity and other information to Martinsburg police detectives.
A warrant was then obtained for this subject and Martinsburg police are still actively investigating this matter to gain more information in regards to the second suspect. Martinsburg Police urge anyone with information regarding the July 17th 2007 West Virginia Ave. robbery to contact the Martinsburg Police Department at 304 264 2100 and or Berkeley County Crime Solvers at 304 267 4999.

Malicious Wounding Arrest
Officers responded to the lobby of Martinsburg City Hall for a person who was reporting a stabbing. The victim was at the police station with a stab wound to his upper right shoulder area and medics were called. The victim was James N. Jordan of 270 Rockyford Road Clear Brooke Va. age 32. He said the stabbing occurred at 302 W. Race Street Martinsburg. The victim said he was stabbed by a person he knows as Charles Redman.
Officers went to W Race St. and found evidence of the stabbing. A witness confirmed that it happened and Redman was still at this location. There appears to be some type of relationship with the parties involved. As a result of an argument, not involving Redman he became involved and stabbed Jordan in the shoulder area. The weapon used was a folding knife that officers believe has been recovered inside the apartment.
Jordan was being treated at City Hospital for this wound which is non-life threatening. Charles Redman age 40 with no fixed address was arrested and charged with Malicious Wounding and was taken to the Eastern Regional Jail to await arraignment.

Drug/Gun Arrest
On July 8th 2008 at 6:50 PM Martinsburg Police Officers PFC S. Everhart and Ptlm. D. English encountered two subjects in the area of East Race Street and Centre Street Martinsburg WV.
Upon investigation involving these people one of the subjects ran from Ptlm. English and fled on foot. This person was apprehended shortly thereafter and was charged with obstructing an officer. The other person was not charged with any criminal offense and allowed to leave the area.
It was said in the complaint for warrant that the suspect that fled was seen throwing a magazine to a handgun as he was fleeing. This item was recovered along with the firearm it belonged to. This was found to be a loaded semiautomatic Taurus .22 caliber pistol.
This person had been arrested before for carrying a concealed and dangerous weapon. A small amount of Marijuana was also discovered on this person.
He was charged with;
Obstructing an Officer
Felony Possession of a Concealed Dangerous Weapon
Simple Possession of Marijuana
He was processed and taken to the Eastern Regional Jail to await arraignment later in the evening by a State Magistrate.

DOB 9 12 76 He lists no fixed address.

Info Needed on Prior Homicide
The Martinsburg Police Department is still actively seeking information in regards to a homicide case which occurred on September 14th 2004, in the area of Cumberland Valley Place (behind the 400 block of Winchester Ave) Martinsburg WV.
This homicide occurred at approximately 3:46 AM on September 14th 2004 and upon the arrival of police the decedent was located in a tan in color Toyota truck slumped in the driver’s seat, apparently unconscious and suffering from multiple gunshot wounds. The victim was taken to the Martinsburg City Hospital by Martinsburg Fire Department personnel where he was later pronounced deceased from gunshot wounds. The cause of death was later ruled as homicide by the State Medical Examiner’s Office.
The decedent was identified as Bart Gilbert Bannar DOB of 11 04 43 formerly of 801 Virginia Ave. Martinsburg WV.

Drug Arrest
On Monday, July 7, 2008, officers from the Martinsburg Police Department responded to the area of High Street and Pennsylvania Avenue after receiving a call from dispatch advising of possible narcotics trafficking at that location. Upon arrival, officers located a subject matching the description of the person reported to be selling narcotics. Officers searched the subject and located a large sum of currency on his person. A search of the surrounding area of the suspect resulted in a plastic bag of crack cocaine being found. The subject, identified as Brandon Spaur, was arrested for Possession of Crack Cocaine with Intent to Deliver.
