Daytime Burglary

On Wednesday, December 16, 2009, officers from the Martinsburg Police Department responded to a residence on West Race Street in reference to a burglary that had occurred. Upon arrival, officers learned that the residence had been broken into and that items including jewelry had been taken. A witness also advised officers that a subject was observed fleeing the area of the residence.

On Thursday, December 17, 2009, officers conducted a search of the area and were able to locate various items of jewelry that were identified as being from the burglary. Further information was also obtained from witnesses that identified the suspect as being Clifford Lee Hutchinson, AKA: Clifford Lee Burke.

On Thursday, December 17, 2009, a warrant was obtained for Clifford Lee Hutchinson for Daytime Burglary. The warrant was issued by Berkeley County Magistrate Joan Bragg. As of the time of this press release, Mr. Hutchinson has not been apprehended. Felony Destruction of Property Arrest

On November 24, 2009, Ptlm. L. D. Ruffner of the Martinsburg City Police Department arrested Tevin Scott Varney of Union View Lane, Winchester, Virginia for one count of felony destruction of property. This arrest stems from recent thefts from various soda machines around November 22, 2009 in the Martinsburg area where the machines had extensive damage or were totaled beyond repair.

Multiple Arrests made

On Friday December 11, 2009 at 2100 hours Officers North and Harper of The Martinsburg City Police Department were investigating a suspicious subject near the intersection of West John and Raleigh Street. The officers knew the subject as Arthur Lee Hairston Jr. and were aware that he had an active warrant for Robbery through Berkeley County Magistrate court for an incident that had occurred on August 30th, 2009. While attempting to arrest Hairston, he attempted to flee from the officers on foot. Officers utilized a TASER to subdue Hairston and were able place him into custody. During a search incident to arrest, officers located a loaded FNH 9mm handgun on Hairston’s person. Hairston (31) (a convicted felon) was charged with First Degree Robbery, Felon in possession of a firearm, Fleeing on foot and Obstructing an officer.

Search Warrent Executed

On Friday, December 11, 2009, the Martinsburg Police Department executed a search warrant at a downstairs apartment at 229 South Maple Avenue, following an ongoing drug investigation. The search warrant was issued by Berkeley County Magistrate, Sandra Miller.

The Martinsburg Police Department utilized its Special Response Team to make forced entry into the residence. Once entering the residence, officers were able to locate drug paraphernalia. Two persons were also arrested on unrelated charges as a result of the search warrant.

Shooting

On Friday, November 27, 2009, at 0301hrs., officers from the Martinsburg Police Department responded to 306 Wilson Street, the Red Cafe bar, for a shooting. Upon arrival, officers were able to locate multiple subjects outside of the bar, two of which had suffered gunshot wounds to lower extremities, including foot and leg. Both subjects were transported to City Hospital for treatment.

Corporal Polinik of the Martinsburg Police Department initially responded on scene and observed a black male standing in the parking lot with a firearm in his waist band. It was advised by Cpl. Polinik that the male took the firearm out of his pants, dropped it on the ground and then proceeded to run back towards the bar entrance. At that point, Cpl. Polinik subdued the male, who was resisting arrest, by utilizing his taser and placed him under arrest. The male was identified as Bryson Bryant.

Officers secured the scene and were able to locate 2 types of ammunition casings in the parking lot where the incident occurred. Several of the casings recovered were consistent with ammunition that could have been fired by the recovered firearm.

A short time after Mr. Bryant’s arrest, officers who were at City Hospital advised dispatch that a 3rd gunshot victim had arrived at the Emergency Room with a leg injury.

All victims were treated for gunshot wounds to the lower extremities and have non-life threatening injuries.

Also arrested was Sequan Baker, who had broken a vehicle window during the incident and provided a false statement.

Poss with the Intent to Deliver Marijuana

On 11-7-2009, at approximately 2019, Ptlm. Albaugh of the Martinsburg City Police Department stopped a white Pontiac Grand Am in the 200 block of W. Race Street for speeding. Upon making contact with the driver, Ptlm. Albaugh detected an odor of an alcoholic beverage and administered field sobriety tests. After the driver failed the tests, she was placed under arrest for DUI. While conducting a search of the driver’s personal belongings, Ptlm. Albaugh located 65 individually wrapped bags of suspected marijuana totaling 70 grams. The driver was charged with possession with intent to deliver a schedule 1 controlled substance (marijuana) and transported to the Eastern Regional Jail awaiting arraignment by a state magistrate. This investigation is continuing, and more charges are expected to be brought forth against the driver at a later time. The arrested was identified as:

Poss w the Int to Deliver Crack Cocaine

On Thursday, October 29, 2009, the Martinsburg Police Department and the Eastern Panhandle Drug and Violent Crime Task Force executed a search warrant at 301 East Burke Street. The search warrant was issued by Magistrate Overington and was issued as part of an ongoing drug investigation.

During the course of the search warrant, officers were able to locate a quantity of marijuana and crack cocaine. The male located within the residence acknowledged that the narcotics were his and was subsequently charged with Possession with Intent to Deliver Crack Cocaine. The male was arrested, processed at the Martinsburg Police Department and was taken to the Eastern Regional Jail to await arraignment.

Poss w the Int to Deliver Crack Cocaine

On Thursday October 29, 2009 Martinsburg City Police Patrolman D.P. North was on West Burke Street when he saw a black Pontiac car with no West Virginia Inspection Sticker. Patrolman North attempted to make a traffic stop in the 7-11 parking lot at the intersection of West King Street and Winchester Avenue. The driver, who was later identified as Durrell Stewart Johnson (23), quickly parked the vehicle in the parking lot, got out and fled on foot. Officer North pursued Johnson behind 7-11, along the tracks. During the pursuit Officer North saw Johnson throw 2 baggies along the tracks. Officer North caught up the Johnson and was able to place him into custody. Officer North retrieved the 2 baggies that Johnson threw, which field tested positive to be crack cocaine. The weight between the 2 bags was approximately 50 grams of crack cocaine. Johnson was charged with Possession With Intent to Deliver Crack Cocaine through Berkeley County Magistrate Court and was transported to ERJ where he is awaiting arraignment.

Fugitive from Justice Arrest

On 10/12/09 at 11:02 a.m. Cpl. F. Polinik went to the Martinsburg Union Rescue Mission to attempt to locate a man wanted on a fugitive warrant out of Florida and Maryland. Cpl. Polinik, assisted by Det. Lt. G. Swartwood and Det. Cpl. S. Doyle, located the man in the Rescue Mission and he was arrested and processed on the following charges:

Jeffrey Lynn Kline, 41 year old man with no fixed address, was arrested on a Fugitive From Justice Warrant from the State of Florida with the originating charges of his probation/parole being revoked for Burglary and Cocaine Possession. Kline was placed in the Eastern Regional Jail to await arraignment before a Berkeley County Magistrate.

Grand Larceny Arrest

On 10-12-09 at 10:12 a.m. the Martinsburg Police Department received a call reporting a larceny of a Laptop Computer from Trinity United Methodist Church located at 220 W. Martin St. When officers arrived on the scene they viewed the Church’s video surveillance system and were able to identify two males that were in the office of Church during the theft. After a short period of time and an investigation officers located the suspects and the computer and subsequently arrested both on the following charges:

(1) Taylor Richard Wasson, Jr., a 24 year old Martinsburg man with no fixed address was charged with Grand Larceny, Transferring Stolen Goods and Conspiracy to Commit Grand Larceny.
Wasson was placed in the Eastern Regional Jail to await arraignment by a Berkeley County Magistrate.

(2) Vernon Wesley Houseright, a 32 year old Martinsburg man with no fixed address was charged with Obstructing an Officer. After he was arraigned before a Municipal Magistrate, who set his bond at $250.00, he was released on his Personal Recognizance.

Missing Juvenile

The Martinsburg Police Department is seeking the community’s assistance in locating a missing juvenile. The police department is requesting any information in regards to the exact whereabouts of Bre’na Beaner.

The juvenile is described as a black female DOB 2/4/92 she is 17 years of age approximately 5-02 in heights and 105 pounds in weight.

She was reported missing on June 25th 2009 and was last seen at a local area high school. She is believed to still be in the Martinsburg, Berkeley County area and may be traveling with a juvenile male acquaintance.

Missing Prescription Pads

On Wednesday, October 07, 2009, the Martinsburg Police Department received a complaint in regards to possible fraudulent prescription notes. Officers learned that an area printing company had printed a quantity of prescription pads for two doctors as part of an order and that several extra pads had been printed, which had been discarded for recycling. Officers were able to locate the discarded prescription pads but learned that approximately 4 pads were missing and may be in circulation.

The Martinsburg Police Department is asking that area pharmacies carefully examine prescriptions issued from both Dr. Ali Moshirfar M.D. and Debora Y. Feeney, M.S.N.-C, of Ashburn VA. Both of the doctors have been alerted of the situation.

ATM Stolen

On Saturday, September 26, 2009 at 0118hrs., the Martinsburg Police Department responded to the Citgo convenience store, located at 1316 Edwin Miller Boulevard in reference to an alarm. Upon arrival, officers found that the door to the business had been broken and that an ATM machine had been removed. Officers were able to view video footage and determine that an unknown subject had removed the ATM from the business and fled with an undisclosed amount of money.

Later on this date, officers from the Martinsburg Police Department were able to locate the ATM machine in a nearby field.

The suspect is described as a black male wearing white or tan pants and a blue jacket.

Marijuana Cultivation Arrest

On Wednesday September 23, 2009 Martinsburg Police Cpl. Justin Darby responded to 205 Timberleaf Lane Martinsburg, WV for an anonymous tip of marijuana plants in the back yard of the house. Cpl. Darby talked to female resident. Darby told the female of the complaint and she agreed to walk with him to the back yard, where Darby located 2 plants, in plain view, which appeared to be marijuana.

The resident stated that she did not know what they were and said that she would get her husband; Joe Daniels Jr, 36. Mr. Daniels came out of the house and told Corporal Darby that “it was just a little experimentation”. Daniels was advised of his Miranda rights. Darby obtained written consent to search the residence from Daniels. During a search of the house officers located 12 additional marijuana plants and cultivation equipment, such as horticulture lights and topsoil that were being used for the cultivation of marijuana.
The plants field tested positive for marijuana. Joe N. Daniels Jr was arrested and charged through Berkeley County Magistrate Court with Cultivation of marijuana and Possession with intent to deliver marijuana. Daniels is currently in Eastern Regional Jail, where he is currently awaiting arraignment from a Berkeley County Magistrate. PFC B.L. Rouse and Ptlm. C. Williamson also assisted with the investigation.



Poss with the Intent to Deliver Crack Cocaine

On September 21, 2009 at 7:15 p.m. Ptlm.Andrew Garcia was traveling through the 100 block of Centre Street when he saw a small group of subjects standing together. Ptlm. Garcia recognized one of the subjects in the crowd and was aware that he was wanted on an outstanding warrant. Ptlm. Garcia turned around to come back to the area the crowd was standing in and they dispersed. Ptlm. Garcia attempted to apprehend Clifton Curtis Slaughter III although Slaughter quickly circled around an E. Burke Street residence before Ptlm. Garcia could apprehend him. Ptlm. J. Harper and Ptlm. D. North arrived on the scene to assist Ptlm. Garcia in searching the path that Slaughter took around the residence before being taken into custody. During the search of that area officers located a loaded handgun and ammunition.

Clifton Curtis Slaughter III was charged with Felony Possession with the Intent to Deliver Crack Cocaine. Slaughter was placed in the Eastern Regional Jail to await arraignment before a Berkeley County Magistrate.

The investigation is continuing in the case of the firearm.

Suspect Wanted for Malicious Wounding

Martinsburg Police is seeking the communities assistance in locating a suspect in regards to a shooting incident which occurred on 9 15 09 in the area of 114 North Maple Ave. In this incident a female was shot in the upper leg and taken to Martinsburg City Hospital and treated and released for her gun shot injury.

Martinsburg Police were able to ascertain the identity of the suspect and obtain a felony warrant for his arrest on the charge of Malicious Wounding from State Magistrate Sandra Miller.

Martinsburg Police are also looking into the possibility that a shooting which occurred in the 100 block of Centre Street later in the evening on 9 15 09 may be related to this suspect. In this shooting incident no one was injured but a projectile did enter a residence through a window on Centre Street.

1st degree Sexual Assault Arrest

On Wednesday, September 9, 2009, officers from the Martinsburg Police Department arrested a 28 year old male at his residence without incident. The defendant was arrested on 1st Degree Sexual Assault and Sexual Assault by Parent/Guardian charges, which stemmed from an incident that occurred on 09/01/09, in which a two year old female was sexually assaulted. The defendant was taken to the Eastern Regional Jail to await arraignment. The names of the suspect and victim are being withheld out of respect to the family.

Fugitive from Justice Arrest

On Wednesday, September 9, 2009, officers from the Martinsburg Police Department arrested Nicholas Jacob Leverich in the 600 block of West King Street as a Fugitive from Justice. Mr. Leverich was wanted for extradition from Florida for Violation of Probation and Home Invasion Robbery. He was arrested without incident and taken to the Eastern Regional Jail.

B and E Arrest

On Tuesday, August 25, 2009 at 1:26 a.m. the Martinsburg Police Department received a business alarm at Kwik Chek located at 301 Rock Cliff Drive.
Responding officers found the glass in the front door had been broken out and another section of glass over another door had been broken. After other officers from the Martinsburg Police Department and the Berkeley County Sheriff’s Department arrived on the scene and secured the perimeter a search of the store was completed by K-9 Deputy T. Heckman of the Berkeley County Sheriff’s Department. Once it was confirmed that the suspect had left the store, the in store surveillance videos were reviewed by officers and it was found that the suspect had stolen a safe from the store.
While Sgt. T.L. Stanley and Ptlm. J. Harper(Martinsburg Police Department) and Cpl. M. Raphann(Berkeley County Sheriff’s Dept.) were tracking marks left by the safe being dragged from the scene a vehicle drove into the area, stopped and turned their lights off. Seconds later they turned their lights back on and attempted to flee the area past officers who were attempting to stop the vehicle. Just moments later the vehicle was stopped by officers from the Martinsburg Police Department, Berkeley County Sheriff’s Department and the West Virginia State Police.

The suspect was a passenger in the stopped vehicle and was still wearing clothing items that he wore during the break in. The suspect, Fuquan Hassian Nath, 35 years of age, of Harris Way, Martinsburg, WV was incarcerated in the Eastern Regional Jail to await arraignment by a Berkeley County Magistrate on felony charges of Breaking and Entering and Grand Larceny. It is believed that all item stolen in the burglary were recovered.

Burglary Arrests

On Friday, 8-21-09 at 1800 hrs, Cpl C M Phelps responded to 104 S Maple Ave for a burglary that had just occurred. Phelps arrived and spoke with the victim / complainant, Barbara Edwards.
Edwards relayed that someone had entered her residence while she and her two grandsons were inside and taken numerous items. As the subject was leaving, Edwards confronted the male who said that he was trying to sell a video game system. Edwards demanded that the subject leave which he did by the back door. Edwards had her grandsons check to see if anything was missing from their rooms upstairs. Edwards was told that one of the grandsons was missing a Nintendo Game Cube system. This was the same game system that the male subject was trying to sell Edwards. Edwards got in her vehicle and began looking for the male while calling 911 for help. While speaking with 911 operators, Edwards located the male and watched him as he entered a residence in the area.

Phelps also learned from another area residence that the male subject had entered his residence as well and had identified himself as John.

Phelps went to the residence that the male had entered and made contact with a person who matched the physical description that Edwards had given. Phelps identified the person as John Andrew Jollon. Jollon was placed in investigative custody while additional information was obtained. Edwards positively identified Jollon as the male who was in her residence. Jollon was arrested and transported to the Martinsburg Police Department for additional processing. While at the Police Department, Jollon provided a written statement confirming that he was the male who took the game system.

Jollon provided Cpl Phelps a location where the stolen items were. Phelps also learned from the victim that she was also missing a MP3 player along with two cell phones. Phelps and Ptlm Albaugh traveled to that location, Lupita’s Grocery Store (149 N Queen St) and spoke with the owner, Jorge Silva. Silva initially stated that Jollon was there trying to sell the items but he left the store with them after Silva told him that he didn’t want to buy them. Silva eventually admitted to Phelps that he had bought the items and Phelps was able to recover the Game Cube and MP3 player. Silva paid Jollon $90.00 for the items. Phelps placed Silva under arrest for Possession / Transfer of Stolen Property along with Obstructing an Officer.

With further investigation Phelps was able to determine that the two cell phones were located with in the residence that Jollon was originally located in.
All property was recovered and returned to the owner after the investigation was completed.

Bank Robbery



On Friday, August 14, 2009, at 10:13 am officers from the Martinsburg Police Department responded to the Mountain Heritage Federal Credit Union, located within the Martinsburg Mall in regards to a bank robbery that had just occurred.

From speaking with witnesses, it was advised that a black male wearing dark clothing, sunglasses and a red baseball style hat with a P emblem (Philadelphia Phillies hat), approached a teller and passed a note demanding money, while also advising verbally that he was armed with a firearm. The suspect produced two separate bags and took an undisclosed amount of currency from two tellers before leaving the bank. Witnesses also observed the suspect enter an awaiting dark in color sedan that was being driven by a second black male before leaving the area.

The suspect was described as a black male, approximately 5’7, mid 20’s to mid 30’s in age and was wearing a dark t-shirt, dark pants, sunglasses and a red Philadelphia Phillies hat. It is also believed that possibly this suspect is the same person who had committed a robbery at the same bank in May of 2009.

Shooting

8/11/09 Officers responded to a shots fired in the 600 block of S. Queen Street at 11:14pm. Officers were told there was a shooting victim at 604 S. Queen Street, the male victim was found on the front porch of the residence. The victim was attended to by EMS personal from Martinsburg Fire Dept. and he was transported to City Hospital .

The victim is Shavar Thompson of 604 S Queen Street Martinsburg WV , age 25 years. Mr. Thompson said he was in the rear yard his home as he was approached by an individual and shot once in the left shoulder . This wound appears to be a thru and thru wound and is non life threatening. The victim said he did not see his attacker, only the muzzle flash of the weapon and said he had no conversation with his attacker. This was a small caliber handgun that was used in this crime and at the time of this release Mr. Shavar was still being treated at City Hospital.

Malicious Wounding Arrest

8/11/09 10:23 pm officers went to 207 N. Raleigh St to a fight involving two males. Officers arrived to find one of the males being attended to by EMS personal from Martinsburg Fire Dept. He was Daniel Callaway , 24 years old. He had obvious facial injuries and was able to say who had attacked him. Witnesses told officers the same information and officers began a search for Matthew Conner of 213 N Raleigh Street Martinsburg WV age 25. This fight was over personal property that had been taken.

Officers located Matthew Conner at 317 W. Martin Street. Conner was arrested and charged with Malicious Wounding and was taken to the Eastern Regional Jail .

Mr. Callaway at the time of this press release was still at City Hospital in Martinsburg undergoing treatment for a possible broken jaw and several lacerations to his head and face.

Battery Arrest

On Thursday, August 6, 2009, at approximately 7:20 P.M. members
of the West Virginia State Police responded to a call for a battery
in progress at 9512 Tuscarora Pike (in Berkeley County).

Upon investigation of responding Troopers, they learned that one
of the parties involved in the incident was an off-duty
City of Martinsburg police officer, John Sherman Jr.

As a result of the investigation conducted by the
West Virginia State Police, a battery warrant was obtained
from Berkeley Co. Magistrate Sandra L. Miller for John Sherman Jr.
Lt. Sherman was arraigned on this battery charge by
Magistrate Miller on Monday, August 10, 2009.

In addition to the West Virginia State Police criminal investigation,
the City of Martinsburg Police Department has launched
an administrative investigation into this incident.

Based upon legal guidance by the Municipal Attorney for the
City of Martinsburg, WV, Lt. Sherman has been placed on
administrative leave with pay pending outcomes of these matters.

Burglary Arrest

On Friday, 7-31-09 at 12:46 AM, Cpl C M Phelps went to the 200 blk of W Race St to help Sgt Ruppenthal who was flagged down by a screaming woman. Phelps arrived and saw two groups of people standing outside. .

Phelps spoke with and identified two of the people as Samantha Riggs and Elvis Artis. Both Riggs and Artis said they were in bed at 222 W Race St when William Pennington entered the house through the unlocked front door and came into the bedroom and began to fight with them. Both Riggs and Artis were assaulted during this confrontation. The fight spilled out into the street and Riggs flagged down Sgt Ruppenthal as he was passing by.
Pennington said that he was lured to the house with the sole purpose of Artis or some other individual assaulting him. He said he never made it into the residence and was assaulted on the sidewalk prior to making it into the house. Once he was arrested and transported to the police station Phelps advised Pennington of his Miranda Rights . Once he was advised of his rights Pennington again told his story but this time he said he was assaulted once he was inside of the residence at 222 W Race St. Pennington was intoxicated while dealing with him.

Phelps spoke with Riggs and she said she and Pennington were ex-boyfriend-girlfriend. The crime that he committed inside of the residence was domestic battery and battery. A No Trespassing Notice had previously been issued to Pennington on 6-23-09.

B and E Arrest

On July 29, 2009, Ptlwn. K.M. Barrett, Pfc. S. Everhart, Pfc. R. Bleigh and Ptlm. J. Luciano of the Martinsburg City Police Department responded to 304 Gussie Avenue, Martinsburg for a breaking and entering in progress. A description of the suspect was given to the officers and the suspect was stopped in the area of Beth Street and Tenino Street in Martinsburg.

The suspect was in possession of a white plastic bag that contained items that were taken from the garage at 304 Gussie Avenue.

The suspect is a resident of 198 S. High Street, Martinsburg, was arrested for Breaking and Entering and was transported to the Eastern Regional Jail in Martinsburg to await arraignment.

The suspect that was arrested is Daniel Barry Shipley, DOB: 04-09-77.

On July 17th, 2009 an individual voluntarily surrendered himself at the Martinsburg Police Department in the accompaniment of his attorney in regards to an outstanding felony warrant for delivery of a controlled substance (Crack cocaine).

Drug Arrest Operation

On Thursday, July 16, 2009, the Martinsburg Police Department conducted an arrest warrant operation, following an on-going drug investigation within the corporate limits of Martinsburg. As a result of the investigation, 17 persons were sought for drug distribution charges and as of the time of this release, 10 have been arrested. During the operation, a search warrant was executed at 323 South Raleigh Street, Apartment 3, Martinsburg WV, in which the Special Response Team was utilized to gain entry and secure the residence. As a result of the search warrant, Donnell Parker was arrested from the residence without incident on two outstanding warrants and an amount of marijuana was seized.

Domestic Battery - 3rd Offense

On July 04, 2009, Pfc. S. Everhart of the Martinsburg City Police Department responded to Franklin Manor Apartments which is on West Martin Street in Martinsburg, for a report of a domestic disturbance. During the investigation it was alleged that 35 year old Jason Shawn Kesner, no fixed address, struck a nine year old female juvenile in the face. Pfc. Everhart placed Mr. Kesner under arrest for domestic battery, third offense.

Mr. Kesner was transported to the Eastern Regional Jail to await arraignment by a Berkeley County Magistrate.

Unlawful Wounding

On July 1, 2009 at 2:05 PM The Martinsburg Police Dept responded to the Berkeley County Rec Center on Woodbury Ave for a Unlawful Wounding Complaint. It was alleged that during a basketball game inside the Rec Center the defendant Lance Washington, age 18 of Martinsburg was trying to shoot the basketball while being defended by Anthony James, age 21 of Charlestown. A foul was called on James and Washington retaliated by punching James in the face with a fist. James was not looking at the time. The punch caused a severe facial injury to James and he was transported to Martinsburg City Hospital by ambulance for treatment. Washington was detained at the scene and placed under arrest for Unlawful Wounding. He was arraigned by a State Magistrate and was later bonded out by a bondsman

July 4th Activities

Martinsburg Police Department is issuing this press release in regards to activities at and around War Memorial Park for Independence Day. Law enforcement officers from the Martinsburg Police Department, Berkeley Co. Sheriff’s Office and West Virginia State Police will be patrolling in and around the Park during the festivities and will be assisted by the Berkeley Co. Deputy Reserves. Officers will patrol on foot, bicycle, motorcycle, ATV and in vehicles. Any criminal violations, (illegal fireworks, public consumption of alcohol, disorderly conduct etc.) will result in arrest or citation AND immediate removal from the park. Officers have been instructed to take a ZERO-TOLERANCE approach to infractions, in order to allow all patrons at War Memorial Park to peacefully enjoy the festivities.

Once again this year the fireworks will be launched from the Townsend property just west of Old Mill and Dry Run Roads and will begin promptly at 9:30 PM. Certain areas of northwest Martinsburg and adjourning areas in Berkeley County will have prohibitions on parking. Signage will be placed designating these areas.

The West Virginia Division of Highways will place variable message boards on Interstate 81 prior to the area of the fireworks, giving advance notice to motorists of the fireworks display. Motorists are not permitted to park or stop along I-81 to observe the fireworks. Police will closely monitor parking and traffic in the area.

Purse Taken

On Monday, June 29, 2009, Pfc. Burner of the Martinsburg Police Department responded to the 600 block of West Addition Street in reference to a purse that had been stolen from a parked vehicle. A witness was located who had observed a white male with tattoos and being 30-40 years of age, take the purse from the vehicle and get into a blue passenger vehicle. The victim advised that the purse contained a check book, ATM card and driver’s license.

Later on this date, Pfc. Burner was advised that the victim’s bank account had been accessed several times at ATM machines and banking institutions.

Shots Fired

On Tuesday, June 30, 2009, at approximately 0400hrs, officers from the Martinsburg Police Department responded to 5 Wilson Street, located in the Wilson Street Apartment Complex in reference to shots fired. Upon arrival, officers located spent shell casings and were advised by several witnesses that an unknown black male had fired several rounds from the residence at another unknown black male. Officers were unable to locate persons involved in the incident but were advised that a fight had taken between the two males in the residence prior to the shooting. It is also not known whether or not any persons had been shot in the incident although officers did not locate evidence that would confirm any person had been struck.

Donald Surber update

The Martinsburg Police Department is releasing a follow up press release in regards to Donald Surber. As previously stated a warrant for felony escape from a correctional facility has been issued for his arrest.

The suspect is still a patient at the Winchester Medical Facility in Winchester Virginia as of the time of this press release.

The Martinsburg Police Department is expecting to complete it's preliminary investigation into this escape, excluding any examinations which may be performed by the West Virginia State Police Crime Laboratory on the forensic evidence.

It is expected that the initial report of the investigation will be finalized later this week and it will then be submitted to the Prosecuting Attorney's Office for review.

Bank Robbery

On Monday, June 22, 2009, at approximately 9am, the Martinsburg Police Department responded to First United Bank & Trust, located at 980 Foxcroft Avenue, in reference to a bank robbery that had just occurred. Upon arrival, officers made contact with a teller who advised that a male subject had entered the business and presented a note which demanded money. The teller complied with the demand and the subject left the bank with an undisclosed amount of currency. The subject then proceeded to the leave the area on foot.

The subject is described as a black male, approximately 5'6- 5'7 in height, early to mid 30's, slender build and having an unshaven appearance. He was wearing a black shirt with a white shirt underneath, a baseball style hat and sunglasses.

The incident was being investigated by the Martinsburg Police Department and the Martinsburg branch of the FBI as well as assistance by the Berkeley County Sheriff's Department.

Inmate Attempts Escape - Shot

On June 19th 2009 at approximately 8:30 PM officers of the Martinsburg Police Department responded to the Martinsburg City Hospital Emergency Rom for a shots fired call.
Once on scene officers secured the area and made contact with witnesses and parties involved.

The investigation revealed, and is alleged in the complaint for warrant that an inmate from the Eastern Regional Jail was brought to the hospital for treatment for self inflicted cuts to his wrists. After being treated for his injuries the inmate bolted from the custody of the two correctional officers assigned to him.

The inmate ran a short distance into the emergency room and attempted to flea but his escape was blocked by the locked emergency room doors. The inmate then turned towards the officers and refused to obey their commands to stop. It was advised the inmate approached the correctional officers and was shot once while reaching for one of the correctional officer’s weapon.

The inmate suffered a single gunshot wound to his arm which also entered his torso and was treated by hospital personnel and later transferred to the Winchester Medical Center in Winchester Virginia.

Evidence was obtained and collected at the scene along with statements from all witnesses including the two correctional officers.

Martinsburg Police Detectives secured a felony warrant for escape from a correction facility for the inmate from State Magistrate Harry Snow. His extradition was approved pending his release from the hospital for his injuries from the Winchester Virginia Medical Center by Berkeley County Prosecuting Attorney Pamela Games Neely.

The Martinsburg Police were assisted in the investigation by members of the West Virginia State Police Crime Scene Unit and the Berkeley County Sheriff’s Department.

Delivery of Imitation Substance

On Monday, June 15, 2009, the Martinsburg Police Department conducted two controlled purchases of narcotics utilizing a confidential informant. During the controlled purchases, two subjects were arrested. Jason Jamar Ross was arrested at the intersection of Race and Raleigh Streets and was charged with delivery of an imitation controlled substance and obstructing. During the second controlled purchase, Justin Ponton was arrested on Welch Street and was charged with conspiracy to deliver an imitation controlled substance. Both persons were processed at the Martinsburg Police Department and taken to the Eastern Regional Jail to await arraignment.

Delivery of Controlled Substance

On Thursday, June 11, 2009, Det. Lt. G.B. Swartwood, Det. S.F. Doyle and Pfc. W.A. Parks conducted a controlled purchase of narcotics utilizing a Confidential Informant.

The C.I. went to the 100 block of North High Street where he/she met with a black male in a white shirt. The unidentified black male got into the C.I.’s vehicle and went to another location. The black male gave crack cocaine to the C.I. in exchange for money. Martinsburg officers then went to the vehicle and located the black male in the passenger seat, where he was taken into custody without incident. The male was identified as Curtis Lane, AKA Curt-Curt, who is also on federal probation. A search of the passenger seat by Det. Lt. G.B. Swartwood revealed the controlled currency next to the passenger seat.


The C.I. turned the crack cocaine into Det. Lt. G.B. Swartwood. Once back at the Martinsburg Police Department the drugs tested positive for cocaine.


Curtis Lane was processed at the Martinsburg Police Department and then taken to the Eastern Regional Jail to await arraignment.

Tires Cut

The Martinsburg Police Dept is investigating a rash of tire slashings that have occurred in various parts of town and more concentrated on the east side on 6/8 and 6/10. Approximately 28 tires have been cut and flattened. People should report seeing suspicious persons walking in their neighborhoods late at night to the Police Dept. Poss w/ the intent to Deliver Heroin

On Thursday, June 04, 2009, officers from the Martinsburg Police Department and the Eastern Panhandle Drug and Violent Crime Task Force executed a search warrant at 200 East King Street, Apartment #2, in reference to an ongoing narcotics investigation. The search warrant was issued by Berkeley County Magistrate Sandra Miller.

Forced entry was utilized at the residence and upon entering; officers located a female in the living room identified as Amber Rockwell and a male near a back bedroom, who was identified as Steven Orr Jr.


A search of the residence was conducted and approximately 23 packets of heroin were located in a back bedroom in a container. At that point, both Mr. Orr and Ms. Rockwell were placed under arrest for Possession with intent to deliver heroin.


Both subjects were processed at the Martinsburg Police Department and were taken to the Eastern Regional Jail to await arraignment.

Poss w/ the intent to Deliver Heroin

On Saturday, 05-30-09, Ptlm Harper and Ptlm Shelton of the Martinsburg Police Department received a tip from a citizen that a residence in town was currently selling illegal drugs.

Harper and Shelton located several of the residents of this location in the downtown area and spoke with them about the complaint. During their conversation the residents consented to a search of the location as long as the other residents who were currently at the house also consented.
Harper and Shelton traveled to the residence and spoke with the homeowner. The homeowner also granted consent to a search the residence. The homeowner stated that she was alone in the house. Upon going upstairs Harper and Shelton located a male subject asleep in one of the bedrooms. Harper and Shelton identified him as Shannon Barney 1/16/73. It was learned that Barney had an outstanding Martinsburg Municipal Court Capias and he was then taken into custody. Barney was searched and a small green container was located in one of his pockets. This container had approximately 3.4 grams of suspected heroin in it. The substance was field tested which revealed a positive result for heroin. Barney also had approximately $371.00 in cash in his pocket as well. Based on packaging of the suspected heroin, the large amount of cash located on his person, and other items located in close proximity to him, Barney was charged with Possession with Intent to Deliver Heroin. Barney was remanded to the Eastern Regional Jail to await arraignment at a later time.

On May 29, 2009, Ptlm. J. Harper, Ptlm. M. Bettis and Ptlm. W. Staub of the Martinsburg City Police Department responded to 317 S. Maple Ave., Martinsburg for a domestic disturbance. During the investigation approximately 12 grams of suspected crack cocaine with an approximate street value of $1,200.00, approximately 5 grams of suspected marijuana with an approximate value of $25.00 and three prescription pills were seized.

A resident of 317 S. Maple Ave. was arrested for possession with intent to deliver crack cocaine and was transported to the Eastern Regional Jail in Martinsburg to await arraignment.

The suspect that was arrested is Brian James Grove, DOB: 11-17-89.

Conspiracy to Deliver Marijuana Arrest

On May 28th 2009 at approximately 4:40 PM Martinsburg Police arrested an individual in the 400 block of West Martin Street for conspiracy to deliver Marijuana. This individual was arrested after she allegedly conspired to deliver Marijuana to a confidential police informant during a covert police investigation.

The suspect was arrested without incident and brought to the Martinsburg Police Department for processing. She was later taken to the Eastern Regional Jail to await arraignment by a State Magistrate.

More arrests in auto scam

On May 27, 2009, Ptlm. E. Gibbons of the Martinsburg City Police Department arrested Aaron T. Hudson on two counts of obtaining money by false pretense. The warrants were signed by Berkeley County Magistrate W. R. Smith and Berkeley County Magistrate J. Overington. Mr. Hudson is currently incarcerated at the Eastern Regional Jail and is awaiting arraignment on the two charges.

The incidents that led to the charges both occurred in the parking lot of the Martinsburg Mall. One incident occurred on May 10, 2009 were Mr. Hudson stated he could fix the victim’s vehicle for $200.00. The victim stated she only gave Mr. Hudson $120.00 for the alleged repair and the victim added she did not witness Mr. Hudson do anything to her vehicle nor did he have any tools with him.

The second incident occurred on May 13, 2009 were Mr. Hudson again approached a female victim and told her he noticed something wrong with her vehicle as she was pulling into the parking lot. Mr. Hudson told the victim he worked at a local auto parts store and could get the part for half of the price. Mr. Hudson told the victim the part would normally cost $80.00 but he could get it for $40.00. The female victim drove Mr. Hudson to the parts store where Mr. Hudson went inside. The victim stated when Mr. Hudson came out of the store she did not see any kind of parts that were supposed to have been purchased. The victim eventually purchased Mr. Hudson a pack of cigarettes and gave him $40.00 for the part he allegedly bought and fixed her car with.

These two cases were investigated by Ptlm. L. Ruffner and Ptlm. M. Bettis of the Martinsburg Police Department.

Possession with Intent to Deliver Cocaine and Heroin

On Monday, May 25, 2009, the Martinsburg Police Department was contacted by management of a local hotel in reference to drug activity from an occupied room. Officers responded to the room and located one occupant, identified as Chandra Gray, under the influence of narcotics. Ms. Gray was then arrested in the room on an outstanding warrant for failing to appear in Magistrate Court. It was also advised that a second occupant of the room, identified as Don McAllister, was not at the hotel at that time.

A short time later, officers were contacted and advised that Don McAllister had arrived back at the hotel and then had gone to Sheetz, located on West King Street. Officers responded to the Sheetz, made contact with Don McAllister in a vehicle and conducted a search of his vehicle. During the search, officers located approximately 5 grams of crack cocaine and 8 grams of heroin. Mr. McAllister was then arrested and charged with two counts of Possession with Intent to Deliver Cocaine and Heroin.

A search warrant was also obtained for Mr. McAllister’s residence located at 953 Tuckahoe Trail, Hedgesville, which was issued by Magistrate Bragg. Officers from the Martinsburg City Police, West Virginia State Police and the Eastern Panhandle Drug and Violent Crime Task Force executed the search warrant at the aforementioned location, which yield a firearm and a small quantity of controlled substances.

Arrest made in Scam

On Thursday, May 21, 2009, Sgt. L. Witt of the Martinsburg Police Department arrested Aaron Hudson on a count of Obtaining Money by False Pretenses, stemming from an incident occurring on 05/07/09. During the incident an elderly couple was approached by a male suspect at an area business who advised them that their vehicle had a mechanical problem. The suspect then advised the couple that he would fix their vehicle for free but that he needed $100 for the part. The couple provided the suspect with the money and waited while he left to get the part. The suspect never returned.

Based upon his investigation, Sgt. Witt was able to determine that the suspect was Aaron Hudson and was able to obtain an arrest warrant from Magistrate Miller.

Aaron Hudson was arraigned before Magistrate Overington and was given a $5,000 cash only bond. He is currently incarcerated in the Eastern Regional Jail.

Bank Robbery

On Monday, May 18, 2009, at approximately 10:27am, officers from the Martinsburg Police Department and a special agent from the FBI, responded to the Mountain Heritage Credit Union, located within the Martinsburg Mall, in reference to a bank robbery that had just occurred. It was advised that prior to arrival, a suspect had entered the bank, presented a note that demanded money to a teller and took an undisclosed amount of currency from two tellers. The suspect then fled from the bank into the parking lot where he left in a small dark blue sedan that was operated by a second suspect.

The suspect that entered the bank is described as a black male in his early to mid 20’s, approximately 5’0 to 5’5, small build and clean shaven. He was wearing a black shirt, black jeans, a pair of black sunglasses and a baseball hat. The suspect did not display a weapon but it is unknown if he had one.

The second suspect was described as a black male wearing a white t-shirt and being in operation of a small blue sedan.

Public Assistance and Scam

The Martinsburg Police Dept is requesting the public’s assistance and also advising of a scam taking place on the south end of town in and around the Martinsburg Mall / Martins area.

Over the last week a suspect has been approaching people on foot while they are in or around their vehicle, targeting the elderly, and telling them that he has noticed some type of mechanical defect with their vehicle. They are told that he is a mechanic and he can fix what is wrong with their vehicle for a very cheap price. He is asking the people to take him to an auto parts store, or just asking for money to get parts that he says he will get and return immediately. He then either does not return or gets something cheap from the parts store. He then crawls under the car and after doing nothing says the part is fixed and he then leaves.

He has been successful in this scam several times over the past week. The suspect is described as a black male about 5-8, 150 lbs and is approximately 47 years old. We are asking if this has happened to anyone recently and the Police were not notified to please call us at 304 264 2100 so that we can further our investigation and charges to be placed on the suspect. If anyone should see the suspect in any of the parking lots please call our department.







Robbery

On Friday, May 15, 2009 at approximately 1:45 a.m. the Martinsburg Police Department received a report of an Armed Robbery at the 7-Eleven located at 201 Winchester Avenue. The investigation revealed that an unidentified white male entered the business and demanded money from a clerk. A weapon was not brandished, but the suspect made a gesture with his hand as if he had one. After obtaining an undisclosed amount of cash from the business the suspect fled the scene by stealing a 2002 Mitsubishi Galant registered to the 7-Eleven clerk. The vehicle was subsequently located unattended in the 500 block of West Race Street. The suspect has not been apprehended and remains unidentified. He is described as being approximately 5’10” with light brown shoulder length wavy hair and wearing a black bandana, a black hooded jacket and camouflage pants. The suspect had no facial hair. Armed Robbery Arrests

On May 8th 2009 at approximately 4:30 AM Martinsburg Police arrested four individuals on the charges of obstructing an officer and later two of these individuals were also arrested for armed robbery. This incident occurred at 519 Virginia Ave. Martinsburg WV.

In regards to this incident Martinsburg Police were called to the area of the 500 block of Virginia Ave. for suspicious persons in which one may have been in the possession of a firearm.

Upon officers arrival the investigation revealed that these subjects entered the residence of 519 Virginia Ave. and a voluntary consent to search was obtained. Cpl J. Darby of the Martinsburg Police Department located and seized a loaded 9 MM Ruger semi auto pistol and a small quantity of controlled substances (Marijuana).

During the initial call for service the Martinsburg Police Department also received a call from a victim advising that he was robbed at gun point by two individuals while in the 500 block of Virginia Ave.

The ensuing investigation resulted in four individuals at 519 Virginia Ave. being charged with obstructing an officer and all four of these subjects were transported to the Martinsburg Police Department.

The victim of the robbery, Saja B. Mohamed 30 years of age and listing an address in Gaithersburg Maryland advised he was robbed of his wallet and $10.00 while in the 500 block of Virginia Ave. He also positively identified one of the robbers while at the police department.

This defendant whom was identified by the victim provided Martinsburg Detectives an audio taped statement advising of his actions concerning this incident and also identified the other individual involved.

James Cornell Evans Sr. DOB 1 18 77 of 838 Spruce Street Hagerstown Md.
Charged with Obstructing an Officer.

James Edward Teat Jr. DOB 11 20 81 of 111 Elizabeth St. Apt. 1 Hagerstown Md.
Charged with Obstructing an Officer.

Ernest Eugene Davis Jr. DOB 8 5 73 of 1018 Linwood Road Hagerstown Md.
Charged with Obstructing an Officer and Armed Robbery.

Eric Dwayne Dickerson DOB 9 9 72 of 303 Woodport Ave. Hagerstown Md.
Charged with Obstructing an officer and Armed Robbery.
All four subjects were arraigned by State Magistrate Joan Bragg and the two charged with armed robbery are currently incarcerated in the Eastern Regional Jail in lieu of bond.

Requesting Community Assistance

The Martinsburg Police Department is requesting the community’s assistance in locating several individuals who are wanted on warrants stemming from a recent rash of thefts from vehicles. Warrants were obtained for the individuals following a traffic stop in which several stolen items were located in a vehicle and other items were located at area pawn shops. These items included GPS units, radar detectors and ipods that were taken from neighborhoods ranging from The Woods resort to the Pikeside area in Berkeley County.
