On Monday, May 25, 2009, the Martinsburg Police Department was contacted by management of a local hotel in reference to drug activity from an occupied room. Ms. Gray was then arrested in the room on an outstanding warrant for failing to appear in Magistrate Court. It was also advised that a second occupant of the room, identified as Don McAllister, was not at the hotel at that time.

Officers responded to the Sheetz, made contact with Don McAllister in a vehicle and conducted a search of his vehicle. During the search, officers located approximately 5 grams of crack cocaine and 8 grams of heroin. Mr. McAllister was then arrested and charged with two counts of Possession with Intent to Deliver Cocaine and Heroin.
